Can I complete the sale of my deceased mother's house before probate is granted?

As an executor of my mother's estate I intend to conduct the conveyancing on her house (I understand this is quite in order). Can the completion date for the sale be in advance of receiving the Grant of Probate or can completion take place only after probate has been granted?

Until the Probate is granted you do not have the legal right to sign paperwork for the sale of your Mother's property and exchange and completion will therefore be dependent upon its issue.

However as the estate appears to be straightforward, obtaining the probate should be a fairly swift process.

It is slightly worrying how someone lacking such basic legal knowledge should ve sufficiently confident to conduct the conveyancing on a property so please come back to us if you need further help.
