Chemical waste dumped on my building plot: what legal liabilities do I have if it causes harm to someone?
Chemical waste has been dumped illegally on a building site I intend to develop but I am not aware whether they are toxic or not. What possible legal liabilities might arise to persons on or off site in the event of personal injury or property damage? I own the site and plan to develop it.
Now that the chemicals are on your land and you are aware of them you could be held responsible if they escaped or if visitors to the site were injured. The site should immediately be made safe and signs erected to warn of the danger.
Ultimately the chemicals will have to be removed.
All of this will be at your expense which is unfortunate. You should contact the environmental health department who may be willing to assist especially as the chemicals were dumped.
