Corner post on car park is regularly clipped by neighbour: can I put up a metal edge to protect it and who is liable if they hit it?
I have recently moved into a new property where the fence around my yard is also the fence around the communal parking area. The corner post is passed when vehicles enter or leave and one particular neighbour has so far taken 3 chunks from this post. As the post is the corner of a three foot high fence and probably sunk several more feet in the ground as one side the land is two foot higher, it would not be easy to replace. What are my rights in protecting the post? Am I able to put a metal corner on it if I inform the neighbours of my intentions? Would I then be liable if they hit the post and damaged their vehicle, or hit a car to avoid the post?
You are permitted to protect the post in whatever way you wish. It would be polite (but not necessary) to warn your neighbours of your intentions but you do not need to change your plan if they object and if they drive into the post rather than them claiming against you, instead you can claim against them for rectifying the damage.
You are not liable for any damage they incur avoiding the post.
