I am going to sell my house soon, but I know that there are a number of dangerous electrical faults in the property. As I understand it, I do not need to have an electrical report done as part of the Home Information Pack, but will the buyer be able to hold me responsible in any way for the dangerous electrical installation?
It is likely that the condition of the electrical faults would become apparent during the preparation of the Energy Performance Certificate that will be required as a consequence of the Home Information Pack, or more likely as a result of any survey or other inspection that may be carried out by a surveyor. In such circumstances it is likely that any buyer would then call upon you to either carry out the necessary remedial works or, as an alternative, call for a re-negotiation in the sale price. It may also be the case that enquiries may be raised by the buyer's Solicitors in respect of electrical faults, which you would need to disclose.
You may also need to disclose such information in the Property Information Forms that are likely to be produced to you by your Conveyancers.
Any buyer will, of course, take the property as it stands. You must of course be careful so as to ensure that there are no misrepresentations and that full disclosure to answers on any questions or forms are supplied.
