My neighbour wants to demolish end of terrace to access rear property development: what rights do I have if I am joined on to him?

My next door neighbour wants to demolish his end of terrace house, in order to access a rear development. He is seeking a party wall agreement from me. Is this a ransoming type of situation? Can he force me to agree?

Walls forming a boundary between two properties are governed by the Party Wall Act which lays down a procedure for serving a party wall act notice. This enables either neighbour to embark upon maintenance of the wall by giving notice and allows the other neighbour to object or set reasonable stipulations.

Your house may enjoy a right of support from your neighbours which would be lost if the work he carries out is not properly supervised.

Overall the procedure is designed to encourage amicable resolution of these issues. You will almost certainly need the assistance of a surveyor and a lawyer to protect your position.

You may be able to insist your neighbour meets the costs of their professional charges.
