Neighbours keep moving the fence and refuse to let us use our right of way despite it being on the deeds: what action can we take?
My new neighbours keep moving my fence at the front of my house claiming they brought part of my front garden. They have also blocked up our rear access that goes through thir garden saying they bought it and we have no rights. It is clearly written in the deeds but they are saying it is not on theirs but they have no proof they will show us. It is making our life very unhappy. Please can you advise what we can do. I have spoke to them but they have such an attitude I got nowhere.
It sounds like your new neighbours are a nightmare.
You need to clearly resolve where the boundary lies. This can involve complex issues. Even if you have clear plans/diagrams, if your neighbours will not adhere to them your only option is to seek a court declaration and an injunction.
We recommend that you appoint a lawyer to review the paperwork you have and to write to your neighbours. We can appoint a lawyer for an agreed set initial fee which will be fixed so you won't be worried by the possibility of escalating legal costs.
