Public liability insurance for road which we use but do not own...
I live on a small housing development of 8 houses. We have a registered housing association for the maintenance of the development's road for which we are responsible. However the access lane of 300m belongs to a local hotel which the hotel does not use. As residents who use the road daily are we responsible for the maintenance of the road and do we have to have public liability insurance, or will the hotels insurance cover the road? The housing association has insured the road is this legal if the hotel already has insurance to cover it?
This is all dependent upon the title deeds to the various properties. I anticipate that the road belongs to the hotel but that their deeds entitle the housing association and its lessees to pass over the road.
If this is the case the deeds probably require the housing association to contribute towards the road' maintenance.
Without sight of the deeds it is not possible to advise on this point and this reply is simply supposition as a result. If the situation is as we anticipate it is wholly appropriate for the housing association to take public liability insurance. I suggest that you raise the matter with the housing association who should be able to assist.
