Tiler's error caused leaking pipe causing extensive damage but he has no liability insurance...
I have recently had my bathroom tiled. The tiler had to screw down the boards as there was movement in them, he did a good job, but the following day we had water running through the ceiling. One of his screws had penetrated a pipe under the boards. We need a new ceiling in the kitchen, new boards in the upstairs bathroom and the kitchen walls re-decorated. Also the bathroom floor needs re-tiling but the tiler doesn't have any liability insurance. I have already used my home insurance to get things moving. Where do we stand as to the tiler not being insured?
Your tiler is clearly liable. The fact that he is not insured does not affect his liability. You are entitled to ask him to pay. You need to assess whether he can afford to pay. If you believe he can afford it and the claim is over £5000 we can appoint a Solicitor to act for you.
Your insurance company may also be interested in pursuing him.
If your insurers pay and do not pursue him you might consider asking him to pay the excess and any resultant increase in the insurance premium. Do not accept any money as final settlement as this would prejudice your insurers' position and potentially invalidate your insurance.
