We have a shared driveway which belongs to us but we have to give our neighbours access to their allotted parking in front of their garage, however our neighbours keep parking on the drive which interferes with our access. What can we do?
We have a shared drive with next door. On the Deeds the land is ours but we have to give them free passage across to their allotted parking in front of their garage. They have two cars, as we all do, but they constantly park both cars on the drive which inhibits our access to the path that leads to our front door. Talking to them hasn't helped so what legal measures can we take to force them to cease this double parking?
Although it would be preferable to inspect the title registers in order to give a definitive answer, from the information you have supplied it would appear that your neighbour has both vehicular and pedestrian rights over the driveway which you state belongs to you. We anticipate that these are rights of way and not rights to park.
We would further anticipate that there are mutual covenants not to obstruct or in any way interfere with the driveway.
Subject to the above, as it would appear that the initial contact has not proven effective, the next course of answer would be for a Solicitor to contact them stating that unless they refrain from parking on the driveway, then Court proceedings will be taken seeking an injunction in this regard.
