Which flat owns the space between the ceiling of one flat and the floor of another?

Which flat owns the space between the ceiling of one flat and the floor of another? We live in a victorian conversion, ground floor flat. We would like to build an extension but the roof height is limited by the flat above. Are we allowed to build only to our existing ceiling height or to halfway between our ceiling and the upstairs neighbour's floor?

How big is the area in question? If the lease is silent on the point you can probably build to halfway between the two, if we are speaking of a small area. I would recommend that before doing so you hold discussions with your upstairs neighbour and freeholder to ensure that there are no problems once the work has been done and paid for.
